Seven-month-old Aniyah Boone died after being rushed to a hospital with still-unexplained internal injuries. Her daycare was then shut-down by state investigators on May 31. Aniyah's mother, Alecia Boone, says that Debbie Devaut, the day care's owner, has yet to contact her more than a month after her child's death.
"If it was an accident I would feel, me personally, I would call that parent and say 'I'm so sorry about what happened to your child,'" said Boone. "I haven't heard from her. She hasn't called to apologize."
A FOX 4 investigation of state records shows numerous violations over the past ten years at Debbie's Daycare, with state inspectors consistently finding more kids than Debbie Devaut was licensed to care for at the facility.
"In my mind, it makes it seem like she was just money hungry," said Boone.
According to state records, one time investigators arrived at the daycare to find Devaut asleep, while another time inspectors arrived to find that she wasn't even there, and had left her adult daughter "alone to care for nine children."
Perhaps the most disturbing state report about the daycare was this: "7-year old girl, plus other girl were found giving a 4-year old boy 'oral sex.' Provider has not reported this incident."
"That makes me even more angry because it makes me think, what happened? What went on?" said Boone when she was showed the state report.
Susan Beers, unaware of the oral sex incident, reported the daycare to state investigators just three days after the incident in 2007 after her grandson came home with hand marks on his arm. She said that she and her husband suspected physical abuse.
"She's a very neglectful daycare," said Beers. "I wouldn't open her back up if somebody paid me a million dollars, I wouldn't want her back open."
But Debbie Devaut has her defenders, including mother Melinda Wilson, who says that despite the violations and the death of Aniyah Boone, she would testify on Debbie's behalf to get the daycare reopened.
""My sister's having a baby soon. If Ms. Debbie opens up I'm going to make sure she's there because I trust her completely," said Wilson.
According to records, the daycare was fined at least twice, but was mostly just issued warnings over the violations. Investigators say that most of the cases were simply too difficult to prove.
Johnson County investigators say they have Aniyah Boone's autopsy report, but are have yet to determine if charges will be filed in the child's death.
Debbie Devaut did not return phone calls from FOX 4 for comment at the time of this report.
A licensing hearing for Debbie's Daycare was scheduled for July 27, but has been pushed back to September 15th.
